Work authorization

The work authorization for temporary residence is issued to foreign nationals who intend to carry out regular duties during a short stay in our country. This authorization aids companies and employees during inspections, helping to avoid substantial fines that may be imposed due to non-compliance. 

Work permit

The validity of the work authorization is contingent upon the duration of stay granted by the International Police upon entry into the country. It can be extended upon securing a Temporary Stay Extension (Tourism).

Transitory Stay

The Temporary Stay (VISTUR) is issued to foreign nationals visiting the country as tourists, with a maximum validity of 90 days. Certain countries are required to obtain a VISTUR from the Ministry of Foreign Affairs prior to entering Chile.

Tourist visa

If a tourist wishes to extend their stay in the country, it is possible to renew the VISTUR for an additional 90 days. To do this, they must apply for a Temporary Stay Extension (Tourism Extension).

Temporary Residence

Temporary Residence in Chile is granted by the National Migration Service (SERMIG) to foreign individuals who wish to reside in Chile for a specified period, with a validity of 2 years.

Reconsideration of Migration Processes

In the event that a residence application is rejected by the Migration authorities, the applicant has the option to request a reconsideration of the decision. This can be done once, using the resources provided by the legislation, and must be accompanied by new evidence supporting their claim.

Identity card for Foreigners

We provide guidance and support in obtaining the identity card, an official document issued by the Chilean Government that certifies the identity of a foreign individual. This is granted by the Civil Registry and Identification under the National Unique Role for Foreigners (RUN).

RUN and RUT

The application for this card is subject to a prior immigration benefit, namely residence. In the case of foreign investors who do not have this benefit, the Internal Revenue Service can grant a temporary RUT, or Tax ID for Investors (SII).

Permanent Residence

Permanent Residence is a status granted by SERMIG to foreign individuals who hold a valid Temporary Residence, allowing them to reside indefinitely and engage in any lawful activity in the country. This status is valid for 5 years.

Nationalization

The Nationalization Letter is a method of acquiring Chilean nationality as stipulated in Article 10 of the Political Constitution of the Republic.

Funds Recovery for foreigners

Yes, as long as you have a Work Authorization with transitory permanence. 

Yes, but only if you meet the requirements of Temporary Residence in Chile, you could make the status change in national territory, otherwise you would have to apply for a Temporary Residence from abroad.

How to obtain a Work Residency for Chile? Currently, all Temporary Residency applications are granted by the National Migration Service, most of which must be requested from outside the national territory. You must meet the requirements of the Temporary Residency subcategories and gather the required documentation.

Currently, there are 13 subcategories of Temporary Residencies for Chile, the most common are:

  • Foreigners who enter the country to develop lawful remunerated activities, on their own or under a relationship of subordination and dependence.
  • Foreigners availed by international agreements.
  • Foreigners who are granted temporary residence by virtue of the principle of reciprocity, or who, by virtue of other international treaties, duly ratified by Chile and in force, have the right to such residence.
  • Foreigners who settle in the country with the aim of studying at educational establishments recognized by the State.

The National Migration Service does not have a set timeframe for granting Temporary Residences. Currently, the processes take between 180 to 250 days to be authorized. However, there are specific cases where the waiting time depends on the country of origin and the documentation provided.

 

It is the official document that certifies your regular residence in the Chilean territory, in it you will find your data, nationality, date of birth, type of residence granted, and authorized stay time.

Once your Temporary Residence is authorized and you enter the national territory with your electronic stamp, you are accredited to request the appointment at the Civil Registry and Identification Service for the obtaining of the National Unique Role for Foreigners.

The Civil Registry and Identification Service is taking between 30 to 45 days to deliver the plastic of RUN for foreigners.

The National Migration Service will grant the benefit of Permanent Residency to the holders of Temporary Residency in those cases where the migration subcategory of which they are holders so admits it, and complies with the requirements of stay in national territory. Permanent Residency can be requested 90 days in advance of the expiration of your current migration benefit.

The National Migration Service takes between 2 to 3 years to send the resolutions of Granted Permanent Residency.

 Yes, this migration benefit is extendable consecutively for as long as you need it. The Extension of Temporary Residence can be requested 90 days in advance of the expiration of your current migration benefit.

Law 21.325 allows four ways to apply for Nationalization, the most requested are:

  • If you have reached 18 years of age, you are a holder of a valid Permanent Residence, and you have five years or more of residence in Chile (counting from when you obtained the Electronic Stamping of the Temporary Residence that gave rise to the Permanent Residence you keep valid) as indicated by Supreme Decree N° 5.142.
  • If you are a permanent resident and can accredit two years of continued residence in the national territory (counting from when you obtained the stamp of the Temporary Residence that gave rise to the Permanent Residence you keep valid), and that according to Law N° 21.325 of Migration and Foreigners, and have any of the following links with the Republic of Chile:
    • Quality of spouse of a Chilean, at least for two years and whose marriage is registered in Chile, always that in the same period the provisions of article 133 of the Civil Code are fulfilled (live in a common home).
    • Relative of Chileans by consanguinity up to the second degree inclusive or if you are adopted by Chileans.
    • Child whose father or mother, having been Chilean, has lost Chilean nationality prior to your birth.

It is a tax benefit aimed at foreign investors who do not have domicile or residence in the country, it is granted by the Internal Tax Service.
